JMComputers Inc & Home Theater General Sales & Service agreement

1.  Agreement: Please read this agreement carefully.  This document is an agreement between the individual and company whose representative signed; here after referred to as “Client” and JMComputers Inc, here after referred to as “Company”.  The company therefore reserves the right to change any of the terms or conditions set forth in this agreement without notice.  The client hereby agrees to all the terms and conditions put forth in this agreement.  The client is believed to be the rightful owner of any equipment serviced by the company, unless otherwise noted.  The client has requested the services and/or sales from the Company on the date of this agreement and agrees to release the Company from any responsibility or lawsuits regarding the loss of data by virus or otherwise; any damage to equipment or personal injury.  The Client also admits the equipment has only a depreciated value to be determined by the Company and the data it may contain therein has no tangible value.

2.  The Policy of the Company is to sincerely handle all business matters honestly and efficiently at a fair price!  To ensure this, any labor taking the company more than 2.5 hours, will require the company to receive a verbal authorization from the client, via phone or in person to continue the labor.

3.  Estimates are an approximate cost, which may be given and approved verbally.  In most cases a 50% estimate fee will be charged before labor is performed or products are ordered.  However, if the estimate is approved, this fee will be applied towards the invoice total at the time of job completion.  Please note, that some customer ordered parts require up to a 75% deposit, before items are ordered. 

4.  Upon completion of service or product delivery, it is the Clients’ responsibility to fully inspect the equipment or ask for assistance in doing so.  Confirmation of signature, on the invoice, check, or online checkout payment is proof that the equipment has been delivered or back to the client’s possession and is operating in satisfactory condition and the Client is completely satisfied with the services and/or products provided.  This confirmation therefore concludes the service provided to the Client by the Company.  Owner Authorized Returns have a processing & restocking fee of up to 30% of product cost.

4a. Notice: Due to nature of some repairs, it may be necessary to make altercations, such as uninstalling software or re-installing the operating system.  If this is the case, the Company will make every effort to backup the data if needed, but be aware that some functionality may change and not be familiar to the Client.  Also please understand that if the services are performed at the offices of the Company, sometimes problems may occur once the equipment is placed back to its original location due to different variables, which may include, but not limited to, different internet service providers, wireless security, phone line static (noise) untested peripherals that were not brought in and more.  If this is the case, please read the labor guarantee below. 

5.  Labor Guarantee:  The Company guarantees its own labor on equipment for a period of 30 days.  THERE ARE NO REFUNDS ON LABOR FEES OF ANY KIND.  If the equipment you originally requested service on should have the SAME PROBLEM, please notify the company within 30 days to have the issue resolved.  The Company can not warrant labor on software issue due to its nature and the tendency that the problem is often a program defect, corrupt files, a virus, malware, or setting changes that the Client may have made.  Please understand that the Company is not the creator or owner of the software and cannot be held liable.  Labor performed at the offices of the Company is warranted only by the same type of labor in exchange, additional charges will apply if a representative is requested to travel to your location.

6.  Parts Warranty: (unless otherwise noted on invoice)

What is not covered / allowed:

 Returns on all custom computers & Special Ordered Items

 3rd party software (Software in which we didn't supply you with) & operating systems

 Problems that result from but not limited to: Water, Sand, Fire, or Environmental, electrical or "Act Of Nature" damages - Physical, or Impact Damage - Damages incurred from misuse, or 3rd Party Accessories or Parts (We recommend you purchase a battery backup)

 Extensive Component Level or Software Technical support by phone

 FREE service, outside of the first 30 days

 

Used Equipment / Computers

 30 day limited warranty includes parts and labor (in-house)

 No on-site service included free of charge

 

Plasma, LCD & All A/V Equipment

 All sales are final - no returns/exchanges – purchases come with a 1 year manufacturers warranty

Billing

Clients who request service via phone approval or in person & then request the company bills them have previously read and understand the terms and conditions of this agreement & no signature required.

 

BUSINESS SERVERS & Network Equipment

If your company purchases a custom built server from JMComputers Inc, it comes with a standard 1 year warranty unless a representative of JMComputers provides your company with a UPS (Battery Backup System), or a representative of JMComputers approves of the UPS (Battery Backup System) that the your company would like the Custom Built Server & Equipment to operate on.  Having an approved or provided battery backup system, warrants your server, for both parts and labor for a three (3) year period from date of original invoice.  Your invoice will reflect your warranty type.

ADDITIONAL CHARGES
Before performing any work, installers will review the Scope of Work and provide an estimate for any work that may be out of scope and thus require an additional charge. Additional charges, fees and expenses may apply if your location is outside our installation coverage area. Payments for additional charges: C.O.D. payable by credit card or personal check.

CABLE/SATELLITE
Installation of cable or satellite service must be performed before the arrival of your home theater installer. This will ensure proper integration of your entire home theater system. If completion of the installation work requires an additional visit for cable/satellite box installation, additional charges may apply.

RESPONSIBILITY
JMComputers Inc, nor the company installers will be held responsible for damages, when client asks for assistance moving any furniture or valuables. JMComputers Inc installers will not, under any circumstances, move, alter or install electrical outlets, you must contact JMComputers Inc directly for electrical installation or modification, so the company may dispatch our qualified electrician. It is recommended to have necessary electrical work performed prior to installation service.

INSTALLATION AUTHORIZATION
Someone at least 18 years of age must be present at all times on the day of installation to approve all work completed.

LABOR ONLY
Installations do not include any parts or accessories (for example, wire, cable, speaker mounts or similar parts), except as specifically set forth prior to installation.

DISCLAIMER
JMComputers Inc shall not be liable for any failure or delay in performance due to any cause beyond its control. If JMComputers Inc's ability to render services is impaired by your failure to cooperate or circumstances beyond the control of JMComputers Inc, JMComputers Inc may choose not to provide services. Service can also be denied if dangerous or unhealthy conditions are present including possible code violations. For any un-installation services provided, JMComputers Inc shall not be responsible for repairing any damage or changes made to your residence or business.  You must contact JMComputers Inc directly for home repair service or modification, so the company may dispatch our qualified repair person/master carpenter.

LATH & PLASTER
JMComputers Inc cannot warrant that installations involving lath and plaster walls will not result in cracks on the wall. JMComputers Inc will do everything in our power to eliminate the possibility, but due to the nature of that type of construction, JMComputers will not be responsible for any resulting damage to your wall.

LIMITATION OF LIABILITY & RELEASE
Except for direct property damage that results from JMComputers Inc's negligence, under no circumstances shall JMComputers Inc be liable to you or any other person for any damages, including without limitation, any indirect, incidental, special or consequential damages, expense, costs, profits, lost savings or earnings or liability arising out of, or related to, the services provided by JMComputers or the installation, un-installation, use of or inability to use your products. Further, by requesting service and allowing the performance of installation services by JMComputers Inc, you agree to release and hold harmless JMComputers Inc against any loss, liability or damage that you or the owner or lessee may suffer, included but not limited to any changes or alterations to your residence or business (for example, changes to walls, baseboards, floors, etc.). Some states do not allow limitations or release of certain damages or liability, so the above limitation of liability and release may not apply to you.

Problems that result from but not limited to: Water, Sand, Fire, or Environmental, electrical or "Act Of Nature" damages - Physical, or Impact Damage - Damages incurred from misuse, or 3rd Party Accessories or Parts (We recommend you purchase a battery backup) are not covered or warranted through JMComputers Inc.

EVERY INSTALLATION INCLUDES:

  • A pre-installation survey upon arrival at home.

  • Connection of your newly purchased components in one (1) room, using exposed wire connections.

  • Integration of your newly purchased component(s) into your existing and working system.

  • When audio or video components are installed, we will program the remote controls for those components. Please note that separately purchased remote controls (like a Harmony® or Universal) can be programmed with the purchase of 1 of our remote programming offers.

  • Guaranteed satisfaction of installations & we guarantee that mounted TV will remain mounted

  • Neatly dressed wires and cables using wire ties when necessary.

  • A brief educational demonstration of the newly purchased components which the installer has connected.

  • Cleanup of wire clippings, drywall dust, or any other debris caused by installation.

  • Note regarding wire/cable concealment: Locations that involve inadequate access for standard wall fishing to the wall where the wire is to be hidden, or the wire is to be hidden in a wall that contains insulation, vapor barriers, or any other obstructions, wire may be concealed by installer-provided paintable or matching track molding (which may require a return visit * charge). Installer will finish wall fished cable exit points with a bushing, plate or spackle. We will spackle any area where access holes were created in the walls. The customer shall be responsible for any repainting.

  • A 1-year limited warranty on all labor included with professional installation services. JMComputers Inc's professional installer will correct any material defects in the workmanship of the installation services you purchased if reported to JMComputers within 30 days of the date services were completed. This limited warranty does not pertain any warranty on parts or equipment.

Service returns cannot be accepted after installation or consultation services are completed.

To cancel or reschedule your appointment, please also call 239-963-1290, 24 hours prior to avoid a $50 cancellation fee. Note: Don't forget to reschedule your installation if you reschedule your product delivery date.
